C3 to C4 change of use
In England, moving a dwelling from use class C3 (typically a single dwellinghouse) toward C4 (many small HMOs) is a planning question. Sometimes permitted development rights allow the change; sometimes an Article 4 direction removes those rights and you need planning permission. This page separates planning from licensing. This page is general information only and not legal, tax, mortgage or financial advice; AgentHMO is not FCA-authorised.
Use classes in plain language
- C3 — commonly a house occupied by a single household.
- C4 — commonly a small HMO (often discussed as 3–6 residents forming more than one household).
- Larger HMOs are often sui generis in planning talk — see the sui generis HMO article for that threshold conversation.
Confirm definitions against the Use Classes Order materials your adviser cites (legislation.gov.uk Use Classes — verify the live instrument).
When permission is required
GOV.UK guidance on when permission is required is the national starting point. Local Article 4 directions can mean a C3→C4 change that would otherwise be permitted still needs an application. Always check the map for the address before you strip walls for extra bedrooms.
Licensing is a second gate
Planning consent (or lawful PD) does not remove HMO licensing duties. Run the licence threshold guide and any selective licensing search in parallel. Housing Act overview: Housing Act 2004 overview.
Practical project sequence
- Planning status / Article 4 check
- Pre-app if unsure
- Licensing and amenity gap analysis
- Fire risk assessment for the intended layout
- Works and certificates
- Licence application if required
- Letting
Skipping to step 7 is how enforcement files open.
Evidence for applications and sales
Keep decision notices, lawful development certificates if any, licence PDFs, and floorplans. Buyers ask. Soft value: AgentHMO valuations.
Neighbour and amenity objections
Parking, waste and noise objections are common on C4 applications in Article 4 areas. A management plan helps communication; it does not guarantee consent.
Devolved nations
C3/C4 labels are England-centric planning slang. Scotland and NI use different planning vocabularies — do not export the labels unchanged.

Lawful development certificates
Where PD rights still exist and you want comfort, some owners seek a certificate of lawful development. That is a planning procedure with evidence standards — not a shortcut past Article 4. Your planner or solicitor decides if it fits.
Enforcement against unauthorised C4 use
Councils can investigate alleged unauthorised HMOs in Article 4 areas. Retrospective applications are possible but uncertain and can carry costs. Operating unlicensed housing on top compounds risk.
Mortgage and insurance disclosure
Tell lenders and insurers about HMO use and any planning limitations. Misrepresenting C3 occupancy while letting as C4 creates claim and default risk. Product outcomes stay with those providers.
Design that matches the class you seek
Layouts that only work at seven occupants may push you out of C4 into sui generis territory. Design the planning case and the licence case together before you build en-suites.
Pre-application documents that help
Floorplans with room uses, a short management statement, and parking/waste notes make pre-apps clearer. Bring the intended occupancy that matches your licence plan so planning and licensing stories do not diverge. Inconsistent headcounts across forms are a common delay.
Permitted development myths
“C3 to C4 is always PD nationwide” is false where Article 4 applies and may be false under other local constraints. Check the property’s planning history for prior enforcement or refused HMO applications before you buy.
Buying with “C4 potential” in the listing
Treat agent claims of easy C4 conversion as marketing. Verify Article 4, prior refusals, and whether the layout can meet amenity standards at the marketed room count. Price the planning risk explicitly in your offer rather than assuming permission will follow completion.
Relationship to selective licensing
Even with perfect C4 planning status, a selective licensing designation can still require a licence for privately rented homes in the area. Run both maps before you call the project “fully permitted.”
Conditions on planning permissions
Where permission is granted, read every condition — occupancy caps, parking, amenity space, or personal permissions. Breaching planning conditions is a separate enforcement track from HMO licensing. Diary discharge of conditions before you spend on furnishings.
Community engagement
In sensitive Article 4 wards, early respectful contact with neighbours about waste and noise management can reduce objection volume. It does not replace the formal application, and it is not a promise of consent.
Internal layout drawings
Submit drawings that distinguish sleeping rooms from living space the same way your licence application will. Planning officers and licensing officers comparing mismatched labels will query both files. Consistency saves weeks.
Frequently asked questions
