Selling an HMO with an existing mortgage / early repayment

Most HMO sales redeem an existing charge on completion. Early repayment charges (ERCs), notice periods and redemption statements sit between you and your lender — not between you and a blog. This page is a process overview only. This page is general information only and not legal, tax, mortgage or financial advice; AgentHMO is not FCA-authorised.

Start with the lender, not the listing photo

Before you price the house, ask your lender (or broker) for:

  • A redemption statement for a target completion window
  • Whether an early repayment charge applies and how it is calculated
  • Any notice you must give before redeeming
  • Whether porting or product-transfer options exist (ask — we do not recommend them)

Figures change with dates. Do not rely on an old statement.

Sale versus refinance — a framing choice, not advice

Some owners compare selling with remortgaging. That comparison needs your own numbers, tax position and goals. AgentHMO will not tell you which is better. If you stay and refinance, underwriting still cares about licence and rent evidence. If you sell, net proceeds must clear the redemption plus sale costs (agent fees and costs).

How pricing still works when there is a charge

Buyers care about the asset and income, not your outstanding balance. Your equity is sale price minus redemption, fees and any ERC. Overpricing to “cover the mortgage” is a common reason HMOs stick. Value routes: get a valuation · methods bricks-and-mortar vs investment · worth framing worth estimate.

Documents the conveyancer and buyer still need

Mortgage or not, HMO packs include licence, safety certificates, tenancies and deposits (completion pack list). GOV.UK HMO licence. Occupied sales: selling while occupied.

Timeline — redemption sits on the critical path

  1. Soft marketing / valuation
  2. Offer accepted
  3. Instruct solicitors; request dated redemption statement
  4. Buyer due diligence (licence, surveys)
  5. Exchange and completion — charge redeemed from sale proceeds

Delays often come from missing certificates or licence queries, not only from the lender. Timeline guide: sale timeline.

Costs beyond the estate agent

  • Early repayment charge (if any) — from your lender
  • Legal fees
  • Agent or auction fees (HMO selling costs and agent fees)
  • Certificate renewals if dates lapse mid-deal

Cash-buyer routes may shorten chain risk but still redeem the charge (quick cash sale). Auction: auction sale.

Negative equity and shortfall risk

If estimated net proceeds may not clear the charge, speak to your lender and a solicitor before you accept an offer. AgentHMO does not negotiate shortfalls or give debt advice.

Tenants while mortgaged

Keep meeting landlord duties and collecting rent until completion unless your solicitor directs otherwise. Possession for sale is a legal process, not a blog tip (Renters’ Rights Act).

Unlicensed or non-compliant stock

Lenders and buyers both dislike licensing gaps (non-compliant sale). Fix or disclose early.

What AgentHMO will and will not do

We can help with sell and valuation enquiries (sell your HMO · HMO valuations · HMO sales overview). We will not recommend mortgage products, calculate your ERC for you, or tell you to remortgage instead of selling.

Building a net-proceeds worksheet (no advice)

Create a private worksheet with columns for: expected sale price (range), agent or auction fees, legal fees, certificate top-ups, estimated ERC (from lender), and the redemption figure on a stated date. The residual is a sketch of equity — not a promise. Update it whenever the redemption statement or offer changes.

Never include your mortgage balance in marketing particulars.

Chains, cash and auction when a charge exists

A buyer chain can slip past your redemption quote’s validity window — request fresh statements. Cash buyers may reduce chain risk but still need time for licence and survey checks (Sell an HMO to cash buyers). Auction completion dates are usually fixed in the conditions (Selling an HMO at auction); align the redemption request with that date.

Licence and mortgage underwriting overlap

Your buyer’s lender (if any) will look at licensing and rental evidence. Gaps that worried your own lender will worry theirs. Cleaning the compliance file helps the sale even though it does not change your ERC (HMO licensing guide).

When equity is thin

If offers sit near the redemption figure, pause marketing bravado. Speak to the lender about options and to a solicitor about risks. AgentHMO will

Solicitor coordination checklist

Give your conveyancer: lender details, latest redemption statement, any ERC correspondence, and the HMO pack. Ask them to diary the statement’s validity date against the proposed exchange. Poor coordination is a common completion slip — not a reason to skip the pack (HMO sale documents checklist).

Frequently asked questions

Can I sell if I am still in a fixed-rate deal

Often yes, subject to your lender’s ERC and notice rules — ask them. Check the related sections on this page and confirm the live position with the council or a suitable professional before you act.

Who pays the early repayment charge

Usually the seller, from proceeds or other funds — confirm with the lender. Check the related sections on this page and confirm the live position with the council or a suitable professional before you act.
